ConveyIQ Privacy Policy

ConveyIQ, Inc. (“ConveyIQ” or “we”) operates mobile apps and the website located at (both referred to as the “Site”). This privacy policy (“Privacy Policy”) explains the ways in which information is collected and used on the Site and any other online and/or mobile services which are owned or operated by ConveyIQ, including all features, content, products and services that may be offered from time to time by any or all of the foregoing. The services, features, content, or applications that may be offered from time to time by ConveyIQ in connection with the Site and/or ConveyIQ’s business are collectively referred to as the “Services.”

By accessing or using the Site or the Services, you are accepting the terms and conditions of this Privacy Policy and agreeing that ConveyIQ will have the right to use your personal and other information as described in this Privacy Policy. If you do not agree to the terms and conditions of this Privacy Policy, you must immediately discontinue your access to and use of the Site and the Services. In addition, this Privacy Policy is to be read together with, and forms a part of, the ConveyIQ Candidate Portal Terms of Use.

I.    Scope

This Privacy Policy covers personally identifiable and non-personally identifiable information collected by ConveyIQ when you visit or use the Site or the Services. Please note that this Privacy Policy does not apply to third parties, including entities that ConveyIQ does not own or control, such as employers that use the Site to conduct interviews with candidates (each, an “Employer”) or third party sites that may have a link to or from the Site.

II.    Definitions

For the purposes of this Privacy Policy, the terms below have the following definitions:

EU Data Protection Legislation” means all applicable legislation relating to data protection in the European Economic Area (the “EEA”), including the EU General Data Protection Regulation 2016/679 (“GDPR”) and all legislation implementing or made under or pursuant to or replacing or superseding the GDPR. Where this Privacy Policy uses terms that are defined in the GDPR but not defined in this Privacy Policy, the definitions set out in the GDPR will apply.

Personal Information” means data relating to you from which you can be reasonably identified. Examples of Personal Information include your name, postal address, email address and telephone number.

III.   Data Controller

With respect to Personal Information that is collected from the Site that is not in connection with a candidate’s interview or interaction with an Employer, ConveyIQ is the data controller responsible for the processing of such Personal Information. If you are a candidate using the Site, with respect to Personal Information that is collected in connection with your interview or interaction with an Employer, the applicable Employer is the data controller responsible for the processing of such Personal Information and may provide its own privacy policy with respect to its use and disclosure of such information.

IV.    What Information is Collected?

ConveyIQ may collect both Personal Information as well as non-Personal Information when you visit or use the Site.

This automatic data is used for website administration, statistical analysis, to monitor the use or performance of the Site and to ensure that the content from the Site is presented in the most effective manner for you.

To the extent this information constitutes Personal Information, we use it to ensure that content from the Site is presented in the most effective manner for you and your device, because is in our legitimate interest to improve our customers’ online experience in relation to the Site.

a.   Logging Your Activities on the Site

When you access the Site from a computer, mobile phone, or other device, ConveyIQ may collect and log information from that device about your browser type, location, and IP address. ConveyIQ may also collect and log anonymous “traffic data” information that does not personally identify you, but that may be helpful to ConveyIQ for marketing purposes or for improving the Services that ConveyIQ offers to its users, such as the pages you visit, the length of your visit, your referring/exit pages, your click-stream activity and the actions you take while using or visiting the Site.

b.   Beacons

ConveyIQ may also use “web beacons”, clear gifs, or similar technologies, to track the activity and flow of your visit(s) to the Site or in other types of communications you might receive from the service. “Web beacons” and clear gifs are small pieces of code placed on a web page to monitor the behavior of and to collect data about the visitors to that page.

c.   Cookies

ConveyIQ may use “cookies” to enhance your use of the Site and the Services and to monitor your activity during your visit(s) to the Site. Cookies are small files that are placed on your browser and the hard drive of your computer, mobile or other handheld device as your browse the Site. The cookies store information about your visit to the Site and to distinguish you from other users.

The use of cookies helps us to display content on the Site and also allows us to obtain and analyze statistics about the use of the Site so that we can improve it. By continuing to use the Site, you consent to our use of cookies as explained in this Privacy Policy.

The following table sets out the cookies used on the Site to the best of our knowledge and provides detail about what they are used for. ConveyIQ does not control the foregoing third party monitoring technologies or the information which they may collect, and ConveyIQ has no responsibility or liability in connection with the foregoing. A third party’s use of the foregoing monitoring technologies and the information collected is subject to the third party’s own privacy policies and is not covered by this Privacy Policy. You can remove or block third party cookies and similar technologies by programming your Internet browser as described above, but in some cases that may impact your ability to access certain portions of the Site and certain Services.

4.   Third Party Analytics Providers; Google Analytics

We work with third party analytics service providers, including but not limited to Google Analytics and Pendo, to help us better understand how you use our Site. For example, we use Google Analytics to learn more about the types of users that visit our Site and to help improve our Site. Google Analytics provides us with certain data regarding the demographics of the users that visit our Site. To provide this service, Google Analytics may collect certain information about you from your computer, including but not limited to: information regarding your visit (such as the pages you visit and the length of your visit), information about your device (such as your IP address), how you got to our Site, and other information about you. V.   Disclosure of Personal Information to Third Parties

We may share your Personal Information with others to confirm your identity, respond to your query, to manage the business, to provide Services and for the purposes identified above. As a result:

a.   If you are not a candidate, we may check your Personal Information by searching for your name and that of your business in publicly available and private databases of businesses and individuals, which will use the details entered by us to provide us with the search results.
b.   If you are a candidate, we may disclose your Personal Information to the Employer with which you are conducting an interview. The Employer will be the controller of such Personal Information and may provide its own privacy policy with respect to its use and disclosure of such information.
c.   We may disclose your Personal Information to third parties who have agreed in writing to provide an adequate level of privacy protection for the following reasons:
i.   where the transfer is necessary to fulfill your request;
ii.   with our vendors working on our behalf, such as call center operators, servicers, marketing providers, and other service providers;
iii.  in connection with a sale, acquisition, reorganization or other disposition of all or part of ConveyIQ’s business or assets, or the insolvency, bankruptcy or receivership of ConveyIQ;
iv.   in connection with the provision of the services to ConveyIQ, or in connection with the transition of service to a new provider;
v.   where you provide feedback or suggestions on product features or services; and/or
vi.   where the disclosure has been requested by you. In this case, ConveyIQ has no control over the use of your Personal Information by any third party. You should carefully review their privacy policies to make sure that you are comfortable sharing your Personal Information with them.

We may also disclose your Personal Information to the following third parties for the following reasons:
a.   to assist ConveyIQ with the management, operation or administration of the Site; the analysis of the performance of the Site; and the provision of ConveyIQ products and Services (including, without limitation, the processing and serving of email and other electronic communications), provided that such third parties maintain appropriate security measures, abide by their obligation of confidentiality, and use Personal Information exclusively for the purpose for which it was provided;
b.   as required by a court order or any other legal or regulatory requirement in order to comply with a legal obligation;
c.   in order to enforce or apply our Terms of Use, this Privacy Policy and other agreements; or to protect our rights, property, safety and the rights, property and safety of others. This includes exchanging information with other companies and organizations for the purpose of fraud protection. We may process the Personal Information for this purpose to comply with a legal obligation and also because it is in our legitimate interests and that of others to prevent fraud.

We will let you know where you must provide us with Personal Information so that we can use it and/or share it with third parties to comply with a legal obligation.  If you do not provide us with the Personal Information in these circumstances, we will be unable to respond to your inquiry and/or engage in further communications with you.

ConveyIQ does not rent, share or sell the Personal Information you share with us to any third party for their own marketing purposes and only shares your Personal Information with third parties as described in this Privacy Policy.

VI.   Records of Personal Information

ConveyIQ will only store the Personal Information as long as ConveyIQ considers it necessary or beneficial for the purposes set out in this Privacy Policy or for regulatory, audit or record-keeping purposes.

We will keep a record of the Personal Information that we receive from you in order to answer your inquiry, to respond to your request for further information or in response to an inquiry from one of our counter parties. We will keep a copy of your Personal Information held for the specific purpose for which it was provided, until the subject matter of your inquiry has come to an end and we no longer need to comply with a legal obligation that requires us to retain your Personal Information. We will delete our copy of your Personal Information in accordance with our Data Retention Policy from the end of our discussions with you, although we may retain a record of the existence of the relationship, to the extent that and for so long as we are required to do so by law. For example, if you have contacted us to ask for the processing of your Personal Information to be erased, we will retain a record of your request in order to ensure that we comply with your wishes. For Employers and candidates, we will keep a copy of your Personal Information for a period of 2 years after the end of the contract with the applicable Employer, or another length of time as required by the applicable Employer.

VII.   Third Party Websites

The Site may contain links to third party websites. By accessing and/or using a linked third party website, you may be disclosing your Personal Information to such linked website. Therefore, you should carefully review the privacy policies of these other websites. If you are not comfortable with the policies of a linked website, you should not access and/or use that website. ConveyIQ is not responsible for the policies (privacy or otherwise) or the content, services or products offered by or through any third party website. It is solely your responsibility to review the privacy policy and other policies of third party websites to confirm that you understand and agree with their policies.

VIII.   Storage and Transfer of Personal Information to Other Countries

If you are located in the European Economic Area (“EEA”), the UK and/or Switzerland and provide data or Personal Information to ConveyIQ, it may be transferred to, processed in, stored at or accessible from a destination outside the EEA, the UK and/or Switzerland. By submitting your Personal Information, you agree to this transfer, processing and storing. We will take all steps reasonably necessary to ensure your data is treated securely and in accordance with this Privacy Policy.

Where we pass your Personal Information from a location inside the EEA, the UK or Switzerland to parties located outside the EEA, the UK or Switzerland that do not offer adequate protection as determined by the European Commission or the applicable regulator, and if the parties are not subscribed to an approved data protection framework (such as the EU-U.S. Privacy Shield framework) that permits us to transfer the Personal Information to them from a location inside the EEA, the UK or Switzerland, we will enter into agreements that enable us to transfer the Personal Information to them and that enable you to exercise your rights in accordance with EU Data Protection Legislation. ConveyIQ is located in the United States, which is a country which has not been deemed to offer adequate data protection by the European Commission. If you provide your Personal Information to us, please note that you are doing so on the basis that you explicitly consent to the transfer of your data outside of the EEA, the UK or Switzerland to the United States.

ConveyIQ also has datacenters within the EEA in Germany and Ireland.  If you provide your Personal Information to us, please note that you are doing so on the basis that you explicitly consent to the transfer of your data to Germany and Ireland.

Please do not provide your Personal Information to ConveyIQ if you do not want this information to be transferred outside of the EEA, the UK or Switzerland or to Germany or Ireland or if the laws in your country restrict these types of transfers. Your provision of Personal Information to ConveyIQ through the Site means that you agree to the terms of this Privacy Policy.

IX.   Your Rights

With respect to the Personal Information that ConveyIQ collects about you from the Site, you may have the right to:

a.   request access to that Personal Information; and/or
b.   where Personal Information is inaccurate or incomplete, ask for Personal Information to be rectified or completed.

In addition, if your Personal Information is subject to EU Data Protection Legislation, you may have the right to:

c.   receive a copy of the Personal Information that you have provided to ConveyIQ in a structured, commonly used and machine readable format so that you can share it with others;
d.   request the transfer of your Personal Information to another party;
e.   ask that Personal Information be erased;
f.   object to us processing your Personal Information by asking for the processing of that Personal Information to be restricted or stopped; and/or
g.   make a complaint to a European data protection authority about the manner in which ConveyIQ processes your Personal Information.

X.   Public Areas of Site

If you choose to submit content for publication in any public area on the Site (such as posting to a public forum or discussion board), ConveyIQ may post or publish your screen name and other identifying Personal Information that you have provided to ConveyIQ.

Furthermore, if you provide information as described above or if you otherwise make any information about yourself publicly available on the Site, you should be aware that any publicly disclosed Personal Information can be read, collected, or used by other users of the Site, and could be used to send you unsolicited messages or otherwise. ConveyIQ is not in any way responsible for the non-disclosure or protection of any Personal Information or other information you choose to publicly disclose on or through the Site. You are solely responsible for all of the consequences resulting from any such public disclosure.

XI.   Data Security

ConveyIQ employs procedural and technological measures that are consistent with legal requirements and standard industry practices and that reasonably designed to protect your Personal Information. For example, if your Personal Information is subject to EU Data Protection Legislation, then we will protect such information in accordance with Article 32 of the GDPR and as required by EU Data Protection Legislation.

Unfortunately, the transmission of information via the internet is not completely secure. Although we are committed to protecting your Personal Information, we cannot guarantee that these security measures will prevent other third parties from unlawfully obtaining the data or misusing it. Any transmission of Personal Information is at your own risk. Nevertheless, as required by applicable data protection laws, we have security policies regarding the storage and disclosure of your Personal Information.

XII.   California Residents: Your California Privacy Rights

If you are a California resident, you may have the right to request and receive certain information about our disclosure of your Personal Information to third parties for their direct marketing purposes, and your choices with respect to such disclosures. Because it is our policy not to share your Personal Information with third parties for their own marketing purposes unless you are first given the opportunity to opt-out of such sharing, we are exempt from having to meet this requirement. XIII.   Do Not Track Requests

ConveyIQ does not track its users across third party websites, nor does it allow third parties to directly collect Personal Information on the ConveyIQ Sites. As such, the ConveyIQ Sites do not respond to browser “Do Not Track” requests.

XIV.   No Information Collected from Children Under 13 Years of Age

ConveyIQ does not seek to, nor knowingly collect, information from children who are under 13 years of age. By using the Site, you represent that you are not under 13 years of age. If a child has provided us with Personal Information, a parent or guardian of that child may contact us to have the information deleted from our records. To do so, contact ConveyIQ through the information provided below.

XV.   Changes to this Privacy Policy

ConveyIQ may from time to time amend this Privacy Policy to reflect changes in ConveyIQ’s practices and the Services. If ConveyIQ makes any material changes to the way ConveyIQ collects, uses, or shares your Personal Information, ConveyIQ will notify you of those changes via a posting on the Site or an electronic communication to you, which will also indicate the effective date of the posted changes. Your continued use of the Site and the Services following the effective date of a change to this Privacy Policy signifies your acceptance of and agreement to the terms of the revised Privacy Policy. ConveyIQ encourages you to regularly review this Privacy Policy so that you remain updated as to any changes.
